AGREEMENT TO TERMS

These Terms of Use (“Terms”) are a legally binding agreement between you (“you”) and City Girls (City Bags) (“City Bags,” “we,” “us,” or “our”) governing your access to and use of our website and any related media, social channels, mobile site/app, or services that link to these Terms (collectively, the “Site”).

USER REPRESENTATIONS

We try to display product colors, features, specifications, and details as accurately as possible; however, displays and settings may vary and we do not warrant accuracy, completeness, or currency. All products are subject to availability, and we may discontinue products at any time. Prices are subject to change without notice.

PURCHASES AND PAYMENT

We accept common forms of payment in India, including Credit Card, Debit Card, Net Banking, UPI, and Wallets (and in-store tender, where applicable).
You agree to provide current, complete, and accurate purchase and account details and to promptly update email, payment method, billing/shipping addresses, and card expiry as needed. All prices are in INR and may include applicable taxes/charges as required.

You authorize us (or our payment partners) to charge your selected payment method for the amounts due, including shipping where applicable. We may correct pricing or other errors even after payment is requested or received.

We may limit or cancel orders at our discretion, including per person/household/account/payment method/address. We may refuse orders that appear to be placed by dealers, resellers, or distributors.

RETURNS

Please refer to our Return/Exchange Policy provided on the Site or available in-store before making a purchase.

PROHIBITED ACTIVITIES

You agree not to:

  • Systematically retrieve data or Content to create a database without written permission.

  • Use the Site for unsolicited communications or account creation under false pretenses.

  • Circumvent or interfere with security or usage restrictions.

  • Frame or link to the Site without authorization.

  • Mislead, defraud, or attempt to obtain sensitive information (e.g., passwords).

  • Abuse support channels or submit false reports.

USER-GENERATED CONTENT & REVIEWS

Where the Site allows you to submit content, you are responsible for your submissions (“Contributions”). You represent that you own or have rights to such Contributions; they must not be illegal, infringing, misleading, abusive, obscene, discriminatory, or otherwise objectionable. Contributions may be visible to others and handled per our Privacy Policy.

Reviews: You must have firsthand experience, avoid offensive or discriminatory language, avoid references to illegal activity, not be a competitor posting negative reviews, and not make false/misleading statements or organize review campaigns. We may accept, reject, or remove reviews at our discretion.

By submitting feedback/suggestions, you grant us a perpetual, worldwide, royalty-free license to use and share such feedback without compensation. You retain ownership of your Contributions; however, you agree we are not responsible for them.

SUBMISSIONS

Any questions, comments, ideas, or other information you send to us about the Site or our offerings (“Submissions”) are non-confidential and become our sole property. You waive any moral rights to such Submissions and warrant you have the right to provide them.

SITE MANAGEMENT

TERM & TERMINATION

These Terms remain effective while you use the Site. We may, without notice, deny access to the Site (including blocking IPs), terminate your account, or remove content for any reason, including breach of these Terms or law. If your account is terminated, you may not register again without our permission. We may also pursue appropriate legal remedies.

MODIFICATIONS & INTERRUPTIONS

We may change or remove Site content or discontinue all/part of our offerings at any time without notice. We do not guarantee uninterrupted availability. We are not liable for any loss/inconvenience due to downtime, suspension, or discontinuance.

GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India. Subject to Mumbai Jurisdiction Only. You and City Bags agree that the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising in connection with these Terms, without prejudice to any rights we may have to seek relief elsewhere to protect our rights.

CORRECTIONS

Information on the Site may contain errors or omissions, including relating to product descriptions, pricing, and availability. We may correct or update such information at any time without prior notice.

DISCLAIMER

The Site is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant accuracy or completeness of content; uninterrupted, secure, or error-free operation; or freedom from viruses/malicious code. Your use is at your sole risk.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, City Bags and its owners, employees, and agents shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages (including lost profits, revenue, or data) arising from or related to your use of the Site, even if advised of the possibility of such damages.

INDEMNIFICATION

You agree to indemnify and hold harmless City Bags, its affiliates, officers, agents, partners, and employees from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of: (1) your use of the Site; (2) your breach of these Terms; (3) your breach of any representation/warranty herein; (4) your violation of third-party rights; or (5) any harmful act toward another user connected to the Site. We may assume exclusive defense of any matter; you will cooperate at your expense.

USER DATA

We may retain certain data transmitted to or generated by the Site for performance/operations. While we take regular backups, you are responsible for your own data. We are not liable for loss or corruption of such data.

ELECTRONIC COMMUNICATIONS, TRANSACTIONS & SIGNATURES

Using the Site, sending emails, or submitting forms constitutes electronic communications. You consent to receive such communications and agree that electronic records and signatures satisfy legal writing/signature requirements.

MISCELLANEOUS

These Terms, together with any posted policies, constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver. If any provision is unlawful or unenforceable, the remainder remains in effect. No agency, partnership, or joint venture is created by your use of the Site. These Terms will not be construed against the drafter.
